On the Site you may watch educational videos or videos about us, educational institutions and other providers. By watching the video content, you agree that we may share your video viewing with or obtain information about your video viewing from analytics providers, advertising partners and third-party social networking sites for two years from the date of data collection, or as permitted by applicable law, unless you withdraw consent.

Although information we collect through these tracking technologies is not always personally identifiable when collected, we may combine such information with personally identifiable information like your name or email address. We collect information from third parties in connection with the operation of our services. For example, we may offer you an option to create an account and log in to the Site using your account credentials through certain third-party social networking sites ("SNSs") such as Facebook. If you elect to register or use the Site using an account you already have with an SNS, we may obtain your information from the applicable SNS pursuant to your agreement with that SNS. The information we collect may depend on the privacy settings you have with the applicable SNS, so please check their privacy and data practices.

We have implemented security measures to help protect against the loss, misuse and/or unauthorized alteration of information you provide to us or that we collect. We will assume that anyone who has the required login/password information for your account is you, so please keep this information confidential and do not share it with anyone.

To provide you with ease of access to your user account, we implement technology that enables us to recognize you as the user account holder and provide you with direct access to your user account without requiring you to retype any password or other user identification when you revisit the Site. You can choose not to take advantage of this feature by unchecking the box "Remember me" when you log in to the Site. Visit "My Dashboard" on the Site to change your setting on access to your user account. You are responsible for maintaining the confidentiality of your account access information and for restricting access to your computer or device through which you access your user account with us. Where possible, users of public or shared devices should log out at the completion of each visit. If you sell or return a computer or device, you should log out and remove your user data as applicable before doing so. Unfortunately, no security system can be guaranteed to be 100% secure. Although we do our best to protect your personal information, we cannot guarantee the security of your information. Any transmission of your information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Cookies are small data files that are stored on your computer's hard drive by your web browser. Cookies may be sent by us or our business partners and service providers when you visit the Site or when you interact with one of our advertisements or other Content. Cookies are stored in your computer or mobile device. In addition to storing your preferences and other information, cookies allow us to gather information about your interactions within the Site and/or with one of our advertisements. You will be required to click to accept the revised Privacy Policy before you may continue to use the Site. Additional Notice for California Consumers

This portion of our Privacy Policy applies to California consumers only. Many visitors to our website are representatives of businesses seeking to interact with us as part of their jobs. This Notice does not apply to information that we collect through these business-to-business interactions.

How We Collect, Use, and Share Personal Information

1. Personal Information Collected on California Consumers in the Last Twelve Months

We collect information from users, as described in our Privacy Policy. The “Personal Information,” as defined in California Civil Code § 1798.140(o), we have obtained on California residents within the last twelve months includes the following:

  1. Identifiers such as name, postal and email addresses, internet protocol (IP) address, unique personal identifier, token identifier, and other contact information when you submit your name and contact information to register for login access and membership subscription or sign up to learn more about our products and services.
  2. The following categories of Personal Information described in California Civil Code § 1798.80(e): (1) the Personal Information listed in the preceding bullet point as “identifiers”; (2) credit card number, debit card number, or other payment information when you purchase membership subscriptions or other products and services; and (3) other information that identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or household, as described herein.
  3. The following categories of protected classification characteristics under California or federal law: race, gender, age (40 years or older), citizenship, physical or mental disability (for testing accommodations), veteran or military status.
  4. Commercial information such as records of products or services purchased, or obtained, or considered from us.
  5. Internet or other similar network activity information, including, but not limited to, browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.
  6. Geolocation data such as physical location or movements.
  7. Sensory data such as audio, electronic, or visual information (commonly, students uploading audio/visual projects and during testing situations).
  8. Current or past professional or employment-related information.
  9. Non-public education records (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99) directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.
  10. Inferences drawn from other Personal Information, such as profiles reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

For each of these categories, we obtain Personal Information from students and/or their parents, teachers, and educational institutions. 

Please note that Personal Information does not include publicly available information from government records, deidentified or aggregate consumer information, and Personal Information protected by certain other sector-specific federal or California statutes.

2. Our Use of Personal Information for Business Purposes in the Last Twelve Months

We use the Personal Information we collect, identified in each of the above categories, for the business purposes disclosed within the Privacy Policy. These business purposes include the following: 

  1. Audits and reporting relating to particular transactions and interactions, including online interactions, you may have with us or others on our behalf;
  2. Detecting and protecting against security incidents, and malicious, deceptive, fraudulent or illegal activity, and prosecuting the same;
  3. Debugging to identify and repair errors in our systems;
  4. Short-term, transient use including contextual customization of ads;
  5. Providing services on our behalf or on behalf of another, including maintaining or servicing accounts, providing customer service, fulfilling transactions, verifying identity information, processing payments, and other services;

  7. Conducting activity to verify, enhance, and maintain the quality or safety of services or devices which we may own, control, or provide;
  8. Administering examinations, performing business operations, and providing notices of results to exam-takers;
  9. Providing information required for entrance examinations to higher education institutions such as universities;
  10. Preparing statistics and performing analysis to support our operations;
  11. Providing students and teachers with information on our educational products and services;
  12. Conducting marketing and surveys regarding our examinations;
  13. Receiving and responding to inquiries;
  14. Providing educational materials related to our examinations; and
  15. Providing transcripts for college credit.

3. Sharing of Personal Information in the Last Twelve Months

  1. Disclosures of Personal Information on California Consumers for Business Purposes

    Within the last twelve months, we have disclosed Personal Information identified in the above categories only (i) for exempt activities, as part of a business-to-business transaction, (ii) at your express request, or (iii) for our business purposes. For more information on the service providers with whom we share information, please see Section 8 (“Disclosure of Your Information – in our Privacy Policy”).

    When we disclose Personal Information for a business purpose, we execute a contract that describes the purpose and requires the recipient to keep Personal Information confidential and not use it for any purpose except performing the contract.

  2. No Sales of Personal Information on California Consumers

    We have not sold any Personal Information described in this Privacy Policy to third parties within the previous twelve months and will not sell Personal Information.

California Rights and Choices

If you are a California resident, you have certain rights related to your Personal Information. Except as otherwise provided by applicable law, you may exercise the following rights for purposes of the Personal Information covered by our Privacy Policy.

  1. Right to Know/Portability

    You have the right to request that we disclose to you certain information about Personal Information we collected about you within the past twelve months. Once we confirm your verifiable request, we will disclose to you:

    • the categories of Personal Information we have collected about you;
    • the categories of sources from which the Personal Information is collected;
    • our business or commercial purpose for collecting Personal Information;
    • the categories of third parties with whom we share Personal Information; and
    • the specific pieces of information we have collected about you.

  2. Right to Opt Out

    We do not offer a right to opt out because we have not sold any Personal Information described in this Privacy Policy to third parties within the previous twelve months and will not sell Personal Information within the meaning of the CCPA.

  3. Right to Deletion

    You have the right to request deletion of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we confirm your verifiable request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. 

    We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

    • complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
    • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
    • debug products to identify and repair errors that impair existing intended functionality;
    • exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
    • comply with the California Electronic Communications Privacy Act;
    • engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
    • enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
    • comply with a legal obligation; or
    • make other internal and lawful uses of that information that are compatible with the context in which you provided it.

  4. Right to Non-Discrimination for Exercise of a California Privacy Rights

    We will not discriminate against you because of your exercise of any of the above rights, or any other rights under the CCPA, including by:

    • denying you goods or services;
    • charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
    • providing you a different level or quality of goods or services; or
    • suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

    We may, however, charge different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by your Personal Information.

    As required under applicable law, we take steps to verify your identity before responding to your request. We may require you to provide information sufficient enough to allow us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. We may limit our response to your exercise of the above rights as permitted under applicable law.  For teacher accounts, we may require further verification from your school to ensure the safety of student information.

    You may designate an authorized agent to make a request on your behalf. As permitted by law, we may require additional verification in response to a request even if you choose to use an agent.

    If you are 16 years of age or older, you have the right to direct us to not sell your Personal Information at any time (the “right to opt out”). We do not sell the Personal Information of consumers we know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt in to Personal Information sales may opt out of future sales at any time.

    Please note we do not sell Personal Information of California Consumers regardless of your age.

Other California Privacy Rights

  1. California “Shine the Light” Law (Civil Code Section § 1798.83)

    Under the Shine the Light Law, a California resident may ask us to refrain from sharing your Personal Information with third parties for their direct marketing purposes. We do not share Personal Information of California Consumers with third parties for their marketing purposes.

  2. Do Not Track

    California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how we respond to “Do Not Track” browser settings. We are not currently aware of a worldwide, uniform or consistent industry technology standard or definition for responding to, processing, or communicating Do Not Track signals. Accordingly, our website is unable to respond to “Do Not Track” requests from browsers. We continue to review new technologies and may adopt a standard once one is created.
